Please read these terms carefully before using BARQ's platform or services. By accessing our website or registering an account, you agree to be bound by these terms.

1. About BARQ

BARQ ("we", "our", "us") is a specialist IT staffing, consulting, and training services company operating across the Gulf Cooperation Council (GCC) region and internationally. We connect verified technical professionals with organisations that require talent, consulting, and managed IT services.

These Terms of Service ("Terms") govern your access to and use of BARQ's website, platform, and services. References to "you" or "user" apply to both professionals registering on our platform and organisations engaging BARQ for services.

2. Eligibility

By using our services, you confirm that:

  • You are at least 18 years of age;
  • You have the legal authority to enter into a binding agreement;
  • The information you provide to us is accurate, current, and complete;
  • You will maintain the accuracy of your information and update it as needed.

3. Professional Registration

Professionals registering on the BARQ platform agree to submit accurate information about their qualifications, experience, and skills. Misrepresentation of credentials is grounds for immediate removal from the platform and may be reported to relevant authorities.

BARQ reserves the right to verify all submitted information and to reject or remove any profile that does not meet our standards. Verification does not constitute employment or guarantee placement.

4. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of any local, national, or international law or regulation;
  • Upload or transmit viruses, malware, or any other harmful code;
  • Attempt to gain unauthorised access to any part of the platform or its related systems;
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the platform;
  • Use automated scripts to collect information from or interact with the platform;
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.

5. Intellectual Property

All content on the BARQ website and platform — including text, graphics, logos, images, software, and design — is owned by or licensed to BARQ and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, transmit, or otherwise exploit any content from our platform without prior written consent from BARQ, except as permitted by applicable law.

You retain ownership of the content you submit to our platform (e.g., your CV, profile information). By submitting content, you grant BARQ a limited, non-exclusive licence to use, process, and display that content solely for the purpose of providing our services.

6. Privacy and Data Protection

Your use of BARQ's platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our platform, you consent to the collection and processing of your personal data as described in that policy.

BARQ processes personal data in accordance with the EU General Data Protection Regulation (GDPR), the UK GDPR, and applicable data protection laws in the jurisdictions in which we operate. Data Processing Agreements (DPAs) are available for enterprise clients and partner organisations upon request.

7. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information disclosed in connection with BARQ's services. This obligation survives the termination of these Terms and any service agreement.

8. Service Availability

BARQ aims to maintain continuous availability of its platform but does not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the platform at any time for maintenance, security, or operational reasons, with reasonable notice where practicable.

9. Limitation of Liability

To the fullest extent permitted by applicable law, BARQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of revenue, data, goodwill, or business opportunities — arising from your use of or inability to use our platform or services.

BARQ's total aggregate liability to you in connection with these Terms shall not exceed the greater of (a) the total fees paid by you to BARQ in the twelve months preceding the event giving rise to the claim, or (b) £100 GBP.

10. Indemnification

You agree to indemnify, defend, and hold harmless BARQ and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your violation of these Terms or misuse of our platform.

11. Third-Party Services

Our platform may contain links to third-party websites or integrate with third-party services. BARQ is not responsible for the content, privacy practices, or terms of those third-party services. Your interactions with them are governed by their respective policies.

12. Anti-Bribery and Ethical Conduct

BARQ is committed to conducting business with the highest standards of integrity. We have a zero-tolerance policy for bribery, corruption, kickbacks, or any form of improper payment — whether direct or indirect. This applies to all interactions with clients, candidates, suppliers, and public officials.

Users of our platform are required to comply with all applicable anti-bribery and anti-corruption laws, including the UK Bribery Act 2010, the US Foreign Corrupt Practices Act (FCPA), and equivalent legislation in all jurisdictions where BARQ operates.

13. Equal Opportunity and Non-Discrimination

BARQ is committed to equal opportunity in all aspects of our business. We do not discriminate on the basis of race, colour, religion, gender, national origin, age, disability, sexual orientation, or any other protected characteristic in our recruitment, placement, or service delivery activities.

14. Modifications to These Terms

BARQ reserves the right to modify these Terms at any time. Significant changes will be communicated to registered users via email or a prominent notice on the platform. Continued use of the platform after such changes constitutes your acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise agreed in writing by both parties.

For enterprise clients operating under a separate Service Agreement, the governing law and dispute resolution provisions of that agreement shall take precedence.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.
